住建部:取消建筑工程方案設計招投標備案、建設工程合同備案近日,為(wei)推進工程(cheng)建(jian)設(she)項目審批(pi)制度改革(ge),住房和城鄉建(jian)設(she)部(以下簡(jian)稱(cheng)“住建(jian)部”)決定修改部分文(wen)件,宣布取消建(jian)筑工程(cheng)方案設(she)計招(zhao)投標、建(jian)設(she)工程(cheng)合同備案等精簡(jian)事項。 4月4日(ri),住(zhu)建(jian)部(bu)官網發(fa)布(bu)《住(zhu)房和城鄉建(jian)設部(bu)關于修改有(you)關文(wen)件的通知》稱,“為推進工(gong)程(cheng)建(jian)設項(xiang)目審批(pi)制度(du)改革(ge),決定對部(bu)分文(wen)件予以修改”。 具體通知修改文件內容(rong)包括: 一、修改(gai)《建筑工程方案設計招標(biao)投(tou)標(biao)管理辦(ban)法》(建市〔2008〕63號) 刪(shan)除第十八(ba)條中“招標(biao)(biao)人和招標(biao)(biao)代理機構應將加蓋(gai)單位公(gong)章的招標(biao)(biao)公(gong)告或(huo)投標(biao)(biao)邀請函及招標(biao)(biao)文件,報項(xiang)目所在地建設主管部門(men)備案”。 二、修(xiu)改(gai)《住房城鄉建(jian)設部關于進一步加強建(jian)筑市場監管工作(zuo)的(de)意見》(建(jian)市〔2011〕86號) 刪除(chu)“(八)推行(xing)合(he)同備(bei)(bei)案制(zhi)度。合(he)同雙(shuang)方要按照有關規(gui)定,將(jiang)合(he)同報項(xiang)目所在(zai)地建(jian)設主(zhu)管部門備(bei)(bei)案。工程項(xiang)目的規(gui)模標準、使用功能、結(jie)構形(xing)式、基(ji)礎處理等(deng)方面發生重大變更(geng)的,合(he)同雙(shuang)方要及時(shi)簽訂變更(geng)協議并報送原備(bei)(bei)案機關備(bei)(bei)案。在(zai)解決合(he)同爭議時(shi),應當以備(bei)(bei)案合(he)同為依據”。 三、修改《住(zhu)房城鄉(xiang)建(jian)設部關于印發<房屋建(jian)筑和市(shi)政基礎設施工(gong)程施工(gong)安(an)全監督規定>的通知》(建(jian)質〔2014〕153號) (一(yi))將(jiang)第七條“縣(xian)級以(yi)上(shang)地方人民政(zheng)府住房(fang)城(cheng)鄉(xiang)建設主(zhu)管(guan)部(bu)(bu)門或其(qi)所屬(shu)的(de)施(shi)(shi)(shi)(shi)工(gong)安(an)(an)(an)全監督(du)機(ji)(ji)構(以(yi)下合稱監督(du)機(ji)(ji)構)應當對本(ben)行(xing)政(zheng)區域(yu)內已辦理施(shi)(shi)(shi)(shi)工(gong)安(an)(an)(an)全監督(du)手續并取得施(shi)(shi)(shi)(shi)工(gong)許(xu)可證的(de)工(gong)程(cheng)項(xiang)目實施(shi)(shi)(shi)(shi)施(shi)(shi)(shi)(shi)工(gong)安(an)(an)(an)全監督(du)”修改為“縣(xian)級以(yi)上(shang)地方人民政(zheng)府住房(fang)城(cheng)鄉(xiang)建設主(zhu)管(guan)部(bu)(bu)門或其(qi)所屬(shu)的(de)施(shi)(shi)(shi)(shi)工(gong)安(an)(an)(an)全監督(du)機(ji)(ji)構(以(yi)下合稱監督(du)機(ji)(ji)構)應當對本(ben)行(xing)政(zheng)區域(yu)內已取得施(shi)(shi)(shi)(shi)工(gong)許(xu)可證的(de)工(gong)程(cheng)項(xiang)目實施(shi)(shi)(shi)(shi)施(shi)(shi)(shi)(shi)工(gong)安(an)(an)(an)全監督(du)”。 (二)將第九(jiu)條“(一)受理(li)建(jian)設(she)單位申請并辦理(li)工(gong)程項目安全監(jian)督手續”修(xiu)改(gai)為(wei)“(一)建(jian)設(she)單位申請辦理(li)工(gong)程項目施工(gong)許可證”。 四、修改《房屋建(jian)筑和(he)市政基礎設(she)施工(gong)程(cheng)施工(gong)安(an)全監督工(gong)作規程(cheng)》(建(jian)質(zhi)〔2014〕154號) (一)將第四條(tiao)“工(gong)(gong)程(cheng)項(xiang)(xiang)目施(shi)(shi)(shi)工(gong)(gong)前,建(jian)(jian)設(she)(she)單(dan)(dan)位(wei)應(ying)當(dang)申請辦理(li)施(shi)(shi)(shi)工(gong)(gong)安(an)(an)(an)全(quan)監(jian)(jian)督(du)手續,并(bing)提(ti)交(jiao)以(yi)下資(zi)(zi)料:(一)工(gong)(gong)程(cheng)概況;(二)建(jian)(jian)設(she)(she)、勘(kan)(kan)察、設(she)(she)計(ji)、施(shi)(shi)(shi)工(gong)(gong)、監(jian)(jian)理(li)等單(dan)(dan)位(wei)及項(xiang)(xiang)目負責(ze)人(ren)(ren)等主要管理(li)人(ren)(ren)員一覽表;(三)危險性較大分(fen)部(bu)分(fen)項(xiang)(xiang)工(gong)(gong)程(cheng)清單(dan)(dan);(四)施(shi)(shi)(shi)工(gong)(gong)合(he)同(tong)中約定的(de)安(an)(an)(an)全(quan)防護(hu)、文明施(shi)(shi)(shi)工(gong)(gong)措施(shi)(shi)(shi)費用支付計(ji)劃;(五)建(jian)(jian)設(she)(she)、施(shi)(shi)(shi)工(gong)(gong)、監(jian)(jian)理(li)單(dan)(dan)位(wei)法定代(dai)表人(ren)(ren)及項(xiang)(xiang)目負責(ze)人(ren)(ren)安(an)(an)(an)全(quan)生產承諾書(shu);(六(liu))省(sheng)級(ji)住(zhu)房城鄉建(jian)(jian)設(she)(she)主管部(bu)門(men)規定的(de)其他(ta)保障安(an)(an)(an)全(quan)施(shi)(shi)(shi)工(gong)(gong)具(ju)體措施(shi)(shi)(shi)的(de)資(zi)(zi)料。監(jian)(jian)督(du)機(ji)構收到建(jian)(jian)設(she)(she)單(dan)(dan)位(wei)提(ti)交(jiao)的(de)資(zi)(zi)料后進行查驗(yan),必要時進行現場(chang)踏勘(kan)(kan),對符合(he)要求的(de),在5個工(gong)(gong)作日內向建(jian)(jian)設(she)(she)單(dan)(dan)位(wei)發(fa)放(fang)《施(shi)(shi)(shi)工(gong)(gong)安(an)(an)(an)全(quan)監(jian)(jian)督(du)告知(zhi)書(shu)》”修改為(wei)“工(gong)(gong)程(cheng)項(xiang)(xiang)目施(shi)(shi)(shi)工(gong)(gong)前,建(jian)(jian)設(she)(she)單(dan)(dan)位(wei)應(ying)當(dang)申請辦理(li)施(shi)(shi)(shi)工(gong)(gong)許可(ke)(ke)證(zheng)。住(zhu)房城鄉建(jian)(jian)設(she)(she)主管部(bu)門(men)可(ke)(ke)以(yi)將建(jian)(jian)設(she)(she)單(dan)(dan)位(wei)提(ti)交(jiao)的(de)保證(zheng)安(an)(an)(an)全(quan)施(shi)(shi)(shi)工(gong)(gong)具(ju)體措施(shi)(shi)(shi)的(de)資(zi)(zi)料(包括(kuo)工(gong)(gong)程(cheng)項(xiang)(xiang)目及參建(jian)(jian)單(dan)(dan)位(wei)基本信息)委托(tuo)監(jian)(jian)督(du)機(ji)構進行查驗(yan),必要時可(ke)(ke)以(yi)進行現場(chang)踏勘(kan)(kan),對不(bu)符合(he)施(shi)(shi)(shi)工(gong)(gong)許可(ke)(ke)條(tiao)件的(de),不(bu)得(de)頒發(fa)施(shi)(shi)(shi)工(gong)(gong)許可(ke)(ke)證(zheng)”。 (二)將第六條中“已(yi)辦理施工(gong)安全監督手續并取得施工(gong)許可證(zheng)(zheng)的工(gong)程項目(mu)”修改(gai)為“已(yi)取得施工(gong)許可證(zheng)(zheng)的工(gong)程項目(mu)”。 此外,上述通知已于2019年03月18日起正式生效(xiao)。 去年(nian)5月,國(guo)務(wu)院(yuan)辦公廳曾印發《關于開展工(gong)程(cheng)(cheng)建(jian)(jian)設項目審(shen)批(pi)制(zhi)度改(gai)革試點(dian)的通知》稱(cheng),“為貫徹落實(shi)黨中(zhong)央、國(guo)務(wu)院(yuan)關于深化(hua)“放管服”改(gai)革和優化(hua)營商環境的部署要(yao)求(qiu),推動政府職(zhi)能(neng)轉(zhuan)向(xiang)減審(shen)批(pi)、強(qiang)監管、優服務(wu),促進市場公平競爭,國(guo)務(wu)院(yuan)決(jue)定開展工(gong)程(cheng)(cheng)建(jian)(jian)設項目審(shen)批(pi)制(zhi)度改(gai)革試點(dian)。” 上述改革試點(dian)通知在(zai)“精(jing)簡審(shen)(shen)批(pi)環節(jie)”部分提出(chu)了“精(jing)減審(shen)(shen)批(pi)事項(xiang)和(he)條件”、“下放審(shen)(shen)批(pi)權限”、“合并審(shen)(shen)批(pi)事項(xiang)”、“轉(zhuan)變(bian)管理(li)方(fang)式(shi)”、“調整審(shen)(shen)批(pi)時序”、“推行告知承(cheng)諾制”等措施。 比如,改革試點通知明確要求,“取消不(bu)符合(he)(he)上位(wei)法和不(bu)合(he)(he)規的審(shen)(shen)批(pi)(pi)事(shi)(shi)項。取消不(bu)合(he)(he)理、不(bu)必要的審(shen)(shen)批(pi)(pi)事(shi)(shi)項。對(dui)于保留的審(shen)(shen)批(pi)(pi)事(shi)(shi)項,要減少審(shen)(shen)批(pi)(pi)前置條件,公布審(shen)(shen)批(pi)(pi)事(shi)(shi)項清單(dan)。取消施工(gong)合(he)(he)同備(bei)案(an)、建(jian)筑節能(neng)設計審(shen)(shen)查(cha)備(bei)案(an)等(deng)事(shi)(shi)項。社(she)會投資的房屋建(jian)筑工(gong)程,建(jian)設單(dan)位(wei)可以自主決定發包方(fang)式。”
